Introduction
These Terms of Service ("Terms") govern your use of the Dployr platform and related services. By using Dployr, you agree to these Terms. The Privacy Policy and Acceptable Use provisions are incorporated by reference.
Service Description
Dployr is a deployment platform that provisions and manages server infrastructure on behalf of customers. Each plan includes a managed server instance, provisioned and hosted by Dployr on DigitalOcean infrastructure, on which customers deploy and run their applications.
Pro plan customers can also connect servers they own and run themselves. Those servers are the customer's responsibility. Dployr provides management tooling only.
The Dployr control plane (dashboard, API, deployment pipeline) is hosted and operated by Dployr.
Account Registration
- You must provide accurate information during registration
- You are responsible for maintaining the security of your account credentials
- You must notify Dployr immediately of any unauthorized access to your account
Subscription and Payment
Certain features require a paid subscription. Payments are processed by Polar.sh. Subscription terms, including billing cycles and cancellation, are displayed at the time of purchase. Dployr reserves the right to modify pricing with 30 days notice.
Acceptable Use
You may not use Dployr for:
- Cryptocurrency mining
- Illegal activities in any applicable jurisdiction
- Malware distribution, phishing, or other malicious activities
- Services that harm humans, animals, or the environment
- Unsolicited bulk messaging or spam
- Circumventing security measures or access controls
- Reselling or sublicensing Dployr services without authorization
- Interfering with or disrupting the platform or other users
Dployr may suspend or terminate accounts violating these terms without prior notice.
User Responsibilities
You are responsible for:
- Securing your applications and managing access credentials for services you deploy
- Ensuring your deployed applications comply with applicable laws
- Your end users and must maintain your own terms of service and privacy policies for services you deploy
- Maintaining backups of your application data and configurations
If you are on the Pro plan and connect your own servers, you are responsible for the security and maintenance of those servers. Dployr does not administer them.
Customer Data and Ownership
You retain full ownership of your configurations, deployment data, and applications. Dployr claims no ownership over customer content or infrastructure. Dployr accesses customer data only to provide the service and does not use customer data for other purposes.
Data Processing
For customers processing personal data of EU residents through services deployed via Dployr, a Data Processing Addendum is available upon request. The DPA establishes Dployr as a data processor acting on customer instructions.
Intellectual Property
- Dployr retains ownership of the platform, branding, trademarks, and proprietary technology
- You retain ownership of your application code and configurations
- Open-source components of Dployr are licensed under the Apache 2.0 license
Service Availability
Dployr aims to provide reliable service but does not guarantee specific uptime percentages. Scheduled maintenance will be announced in advance where possible.
For managed server instances provisioned by Dployr, availability is subject to the underlying infrastructure provider (DigitalOcean). For servers connected by the customer on Pro plans, availability depends on the customer's own infrastructure and is outside Dployr's control.
Dployr is not responsible for downtime caused by:
- Third-party infrastructure providers
- User misconfiguration
- Circumstances beyond reasonable control
Limitation of Liability
Dployr is provided as-is without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
Dployr is not liable for:
- Data loss
- Security breaches on user instances
- Service interruptions
- Loss of profits
- Indirect or consequential damages
Total liability is limited to fees paid by you in the 12 months preceding the claim.
These limitations apply to the fullest extent permitted by applicable law. Some jurisdictions do not allow certain limitations, so some may not apply to you.
Indemnification
You agree to indemnify Dployr against claims arising from:
- Your use of the platform
- Your deployed applications
- Your violation of these terms
- Your violation of applicable laws
- Claims by your end users
Account Termination
Dployr may suspend or terminate accounts for:
- Terms violations
- Non-payment
- Abusive behavior
You may delete your account at any time through the platform or by contacting support.
Upon termination, user data will be deleted in accordance with the Privacy Policy. Data export is available prior to termination upon request.
Modifications to Terms
Dployr reserves the right to modify these terms. Material changes will be communicated via email or dashboard notification at least 30 days before taking effect. Continued use after changes take effect constitutes acceptance.
If you do not agree to modified terms, you must stop using the platform.
Governing Law and Disputes
These terms are governed by the laws of your jurisdiction of residence. Disputes will be resolved through good faith negotiation. If negotiation fails, disputes may be resolved through binding arbitration or the courts of your jurisdiction, at your choice.
Severability
If any provision of these terms is found unenforceable, the remaining provisions remain in effect.
Entire Agreement
These terms, together with the Privacy Policy and any applicable DPA, constitute the entire agreement between you and Dployr.
